“Trade name” or “commercial name” means any name used by a person to identify his or her business or vocation. Trade names are not registrable under the Lanham Act. A trade name is used to identify and distinguish business entities, as opposed to marks which identify and distinguish goods or services. McDonalds is an example of a trade name.
