A concurrent use proceeding is an inter partes (between party) proceeding between several parties who’ve been granted registrations for the same mark covering different geographical parts of the country. This proceeding is conducted before the Board of Appeals and commences following publication of a mark for opposition. The first user or registrant is entitled to nationwide registration, subject to the second party’s use area. A concurrent use proceeding is much less common than a proceeding in opposition.
