When a trademark is registered on the Principal or Supplemental Registers it can be marked with a trademark symbol or statutory notations. The most commonly used way to mark a good or advertisement of service with the trademark symbol is the ® or “Circle R.” If the circle R is used with an unregistered mark, or is used in connection with the goods or services other than for which it was registered, it is considered as fraud on the Trademark Office. If a circle R is used with the mark, the registrant is not precluded from recovering profits and damages in an infringement suit.
